States have varying laws regarding automobile accidents. However, most states fall into two main categories, no-fault and at-fault.
No-Fault states design their laws so that each person involved in an accident is responsible for his or her own loss. Approximately 50% of states employ such laws.
Fault does come into play in some of these states under certain circumstances such as severe injury, in which a jury may attribute fault to one party.
